These Terms of Service ("Terms") govern your access to and use of DeliveryBook (the "Service") operated from Pakistan. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract under Pakistani law to use DeliveryBook. By signing up, you confirm that you are authorized to act on behalf of the restaurant you register.
2. Your account
- You are responsible for all activity that occurs under your account.
- Keep your password secure. Notify us immediately at support@deliverybook.pk if you suspect unauthorized access.
- You must provide accurate, current information and update it when it changes.
- One account per restaurant. Sharing accounts across organizations is not permitted; create team members under your organization instead.
3. Acceptable use
You agree not to:
- Use the Service for any illegal purpose or in violation of Pakistani law.
- Interfere with or disrupt the Service, servers, or network.
- Attempt to gain unauthorized access to other restaurants' data or to our infrastructure.
- Reverse engineer, decompile, or scrape the Service.
- Upload malware or harmful code.
- Resell, rent, or sublicense the Service without our written permission.
- Submit false rider information or misuse the platform to evade labour or tax obligations.
4. Subscription and billing
- DeliveryBook offers Basic (free), Pro, and Enterprise plans. Current pricing is shown on the homepage.
- Pro and Enterprise plans are billed in advance for each billing cycle (currently monthly).
- New accounts may receive a free trial. At the end of the trial, you must upgrade to a paid plan or be moved to Basic.
- Unpaid invoices enter a 7-day grace period. After the grace period, the account is suspended until payment is received.
- Subscriptions renew automatically unless cancelled before the next billing date.
- Fees are non-refundable except where required by law.
- We may change prices on at least 30 days' notice via email or in-app banner.
5. Our service commitments
- We will make commercially reasonable efforts to keep the Service available 24/7.
- We will not access your data except to operate, secure, or improve the Service, or as required by law.
- We will notify you within a reasonable time if we become aware of any security incident affecting your data.
- We may perform maintenance with prior notice when possible.
6. Data ownership and rider data
You retain ownership of all data you submit ("Customer Data") including rider records, orders, and reports. You grant DeliveryBook a worldwide, non-exclusive licence to host, process, and back up that data solely to provide and improve the Service.
You confirm that you have the legal right to add rider information to the platform under applicable labour, employment, and privacy laws, and that you will inform riders that their data is processed via DeliveryBook in accordance with our Privacy Policy.
7. Intellectual property
DeliveryBook, our logos, and the underlying software are our intellectual property. These Terms do not grant you ownership of anything other than the right to use the Service in accordance with these Terms.
8. Termination
- By you — close your account at any time via Settings or by emailing us. See Delete your account.
- By us — we may suspend or terminate accounts that violate these Terms, are abusive, or fail to pay invoices after the grace period.
- On termination, your access ends immediately. We will delete your data within 30 days, subject to retention obligations described in the Privacy Policy.
9. Disclaimers
The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.
DeliveryBook is a tool to help you manage your operations — you remain solely responsible for paying riders, complying with labour law, and any decisions you make based on data in the Service.
10. Limitation of liability
To the maximum extent permitted by law, DeliveryBook and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to the Service.
Our total cumulative liability for any claim arising under these Terms is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim, or PKR 5,000, whichever is greater.
11. Indemnity
You agree to indemnify and hold DeliveryBook harmless from any claims, losses, or damages arising from (a) your violation of these Terms, (b) Customer Data you submit, or (c) your violation of any law or third party right.
12. Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute will be resolved in the courts of Multan, Pakistan, unless a different forum is required by law.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated at least 14 days before they take effect via email or in-app banner. Continued use after the effective date constitutes acceptance.
